These terms govern your use of NepAI ("the Service"), operated from Nepal. By creating an account or topping up credits you agree to be bound by them. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use NepAI. By signing up you represent that you meet this age requirement and that the information you provide (name, email) is accurate.
2. Account & credits
- You are responsible for keeping your account credentials secure.
- Credits purchased via Khalti or eSewa do not expire but are non-transferable.
- Credit bonuses on larger packs are promotional and may change without notice for future purchases.
- We may charge credits for any generation request that reaches the model provider, including failed runs caused by user input. Refunds happen automatically when our pipeline detects the failure.
3. Acceptable use
You agree not to use NepAI to generate, request, or distribute:
- Sexual content involving minors. This is an absolute prohibition and offenders will be banned and, where applicable, reported to authorities.
- Non-consensual intimate imagery of real people.
- Content that impersonates a real person without permission, particularly public figures, in defamatory or misleading ways.
- Content that promotes terrorism, violent extremism, or self-harm.
- Spam, malware, phishing assets, or content intended to deceive at scale.
- Content that infringes copyright, trademark, or other intellectual property of others.
We employ prompt-level keyword filtering and model-level safety filters. We may also act on user reports. Violations lead to credit forfeiture and account termination. Repeated abuse may be reported to Nepalese law enforcement under the Electronic Transactions Act, 2063.
4. Ownership of generated content
Subject to your compliance with these terms, you own the outputs you generate and may use them for personal or commercial purposes. You acknowledge that generative AI models can produce similar outputs for different users; non-exclusivity is inherent to the technology.
You grant NepAI a limited, non-exclusive license to store your outputs on our infrastructure so that you can access them via your gallery. We do not train models on your outputs.
5. Service availability
The Service depends on third-party model providers (e.g., Replicate) and Nepalese payment gateways. We do not guarantee uptime. We will make reasonable efforts to communicate planned downtime in advance via email or in-app.
6. Suspension and termination
We may suspend or terminate your account for violations of these terms. Unused credits at the time of a termination for cause are forfeit; in any other case we will refund the cash value of unused credits at the purchase rate, processed via the original payment method where possible.
7. Disclaimers
The Service is provided "as is". Generated content may be inaccurate, offensive, or otherwise objectionable. You are responsible for reviewing outputs before use, especially in commercial or public contexts.
8. Limitation of liability
To the extent permitted by law, NepAI's aggregate liability arising from your use of the Service is limited to the amount you paid us in the twelve months preceding the claim, or Rs 1,000, whichever is greater.
9. Changes
We may update these terms. Material changes will be notified via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
